By accessing or using the Back in the Box Consulting, LLC website (the "Website") and the services provided by Back in the Box Consulting, LLC (“BITB,” "we," "us," or "our"), you ("User" or "you") agree to be bound by these Terms of Use and all other applicable laws and regulations. If you do not agree to these terms, please do not use our Website or our services.

We reserve the right to modify these Terms of Use at any time. Any changes will be effective immediately upon posting to the Website. Your continued use of the Website after any changes indicates your acceptance of the new terms.

BITB provides training and consulting services including without limitation, project management principles and practices and their applications in work, home, school and recreation (the "Services"). These Services may include in-person training or consulting activities and similar content accessible via the Website. We reserve the right to modify or discontinue any part of the Services at any time.

To access certain features of the Services, you may be required to create an account. You agree to provide accurate and complete information and to update your account as necessary. Access to certain parts of the Services may require payment. All payments are non-refundable unless otherwise stated in a separate agreement. We reserve the right to change our fees at any time.

We may terminate or suspend your access to the Website and Services at our discretion, without notice, for conduct that we believe violates these Terms of Use or is harmful to other Users, us, or third parties, or for any other reason. 

12. Governing Law 

These Terms of Use shall be governed by and construed in accordance with the substantive and procedural laws of the State of Minnesota without regard to its conflict of law principles. 

13. Dispute Resolution 

Any disputes arising out of or relating to these Terms of Use or your use of the Website or Services the parties shall first attempt to resolve the dispute through mediation in Hennepin County, Minnesota. If the mediation is unsuccessful, you further agree to submit the dispute to binding arbitration in accordance with the rules of JAMS. The arbitration shall take place in Minneapolis, Minnesota and the arbitrator's decision shall be final and binding. 

14. Severability 

If any provision of these Terms of Use is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. 

15. Entire Agreement 

These Terms of Use constitute the entire agreement between you and BITB regarding the use of the Website and Services and supersede all prior agreements and understandings.
